Puerto Rico’s first Medical Marijuana Dispensaries are starting to open!

Puerto Rico legalized Medical Marijuana in early 2015, and medical dispensaries started to open their doors to the public in January 2017. The U.S. Territory has not been very tolerant of cannabis use, and the act of smoking THC in any form is still illegal. Medical Marijuana patients can access topicals, edibles, and other means of THC consumption, but cannot smoke.

Puerto Rico currently has about 9,000 registered patients. Medical Marijuana Patients are allowed to purchase a 30 day supply each time they make a purchase, but they are also entered into a database so that a patient cannot go to multiple dispensaries in a day.

Is Marijuana legal in Puerto Rico?

Yes, medical marijuana is legal in Puerto Rico. Currently, in order to purchase from a licensed store, you need a medical marijuana card, which you can get from specific doctors in the territory. The first licensed dispensaries have recently started opening, so if you have a medical card, get out there and make a legal purchase!

Can I get my Medical Card if I am not a Puerto Rico resident?

Yes! If you have a valid medical marijuana card that is government issued, you can make a medical marijuana purchase at one of the dispensaries in Puerto Rico.

Where can I buy marijuana?

If you have a Medical Marijuana Card you can visit one of the territory-licensed dispensaries in Puerto Rico.

What do you need to purchase cannabis in a dispensary?

You currently need a valid medical marijuana card, which you can get from specific doctors in the territory.

What types of marijuana will the dispensaries sell?

This is where things get interesting. Puerto Rico has legalized medical marijuana, but the act of smoking marijuana is still illegal with or without a card. No dispensaries are legally allowed to sell raw marijuana flowers. Dispensaries will sell a number of other types of marijuana products though, including but not limited to:

  • Pills: These will administer THC slowly over a longer period of time.
  • Transdermal Products: These are similar to nicotine patches, and insert THC directly to the bloodstream.
  • Oral Drops: These will be liquid THC
  • Topical Products: creams, lotions, massage oils and such infused with cannabis. These products are not psychoactive and will not get you high.

How much Marijuana can I buy?

Dispensaries are allowed to sell up to a 30-day supply at one time. What constitutes a 30 day supply? We have no idea! As people smoke at different rates, determining what exactly constitutes a month supply is rather difficult

Can I take my purchase home if I live in another state or country?

No. All marijuana and marijuana products purchased in Puerto Rico must be consumed in Puerto Rico. Do not risk crossing federal lines with marijuana.

Where can I consume my recent purchase?

Under the current law, patients may only consume marijuana in a private residence.

If marijuana is legalized can I still get in trouble?

Yes. You can always get in trouble at the federal level, but as long as you follow the rules for marijuana in Puerto Rico, Territory and local authorities will not have any issues with you.

Is weed legal in Puerto Rico?

Puerto Rico has legalized medical cannabis use, but adult (recreational) use remains illegal.

Legislation history

In 2015, Gov. Alejandro Garcia Padilla signed Executive Order OE-2015-010 , ordering the Secretary of Health to authorize some or all components of the marijuana plant for medicinal use for patients residing in Puerto Rico.

Department of Health Administrative Order No. 352 set up initial directives for the possession, cultivation, manufacturing, production, fabrication, dispensing, distributing, and research of medical cannabis.

In July 2017, Padilla signed Act 42-2017 , The Medicinal Act, which replaced the original executive order and set up a legal framework for medical marijuana in Puerto Rico.

Regulation 9038 , enacted in July 2018, further specified the requirements for authorized physicians and allowed for Puerto Rican dispensaries to serve registered patients from US states or other countries where medical marijuana is legal.

The Department of Health (Departamento de Salud) is responsible for regulating Puerto Rico’s medical marijuana program .

Patient registry

Puerto Ricans looking to access medical marijuana must go through an application process and pay a $25 fee. The steps are:

  1. Obtain a medical recommendation from an authorized doctor, which will be sent through the registration platform
  2. Open an account
  3. Create a request and locate the doctor’s medical recommendation
  4. Complete the privacy policy
  5. Submit a passport-size photo
  6. Attach the remaining documents

Purchase

Registered patients with a valid medical marijuana program card can purchase cannabis at a state-approved dispensary .

Consume

Consumption is limited to private homes or private places where owners authorize the consumption of medical cannabis. According to marijuana laws in Puerto Rico, smoking weed is illegal, but the following forms of consumption are allowed:

  • Capsules or tablets
  • Concentrates
  • Edibles
  • Oil
  • Oral drops
  • Oral inhalers
  • Suppositories
  • Topical ointments and creams
  • Transdermal patches
  • Vaporization of cannabis flower or concentrate
  • Any other means that the Department of Health authorizes

Possess

Registered patients in Puerto Rico are allowed a daily amount of 1 ounce (28 grams) of flower or 8 grams of THC in concentrate or edible form. They can possess up to 30 days’ worth at a time.

Home cultivation is not permitted.

  • Severe nausea
  • Spinal cord injury
  • Any condition that causes cachexia, or wasting disease

Reciprocity

Puerto Rico does allow dispensaries to serve patients with medical cards from their home state or other countries.
